1. DEFINITION AND SUBJECT OF THE CONTRACT

1.1 - This contract ("Contract") is a distance contract within the meaning of Art. 50 et seq. Of Legislative Decree No. 206 of September 6, 2005 ("Right of Withdrawal").

The Contract has as its object the sale of movable goods between:

Safarà S.r.L., with registered office in Turin, Via Melchiorre Gioia 11- Turin and Operating Office in Collegno, Via Vacchieri 8,
P.I. 11807650012 ( hereinafter "Safara-cucito.it" or " Safarà - Tutto per il Cucito ) and the consumer (the "Customer").

The Contract is concluded directly through the acceptance by Safarà S.R.L. of a purchase proposal issued by the Customer by telephone or through the Internet, following the invitation to offer contained in the website www.safara-cucito.it (the "Site") and/or through other distance selling systems of Safarà-Cucito.it, on the basis of the methods described in Article 3 below.


1.2 - These general conditions of sale ("General Conditions") and, in particular, the information referred to in Article 52 of the Consumer Code, as provided by Safarà-Cucito telephonically to the Customer and reported on the Site, will remain valid and effective until they are modified and/or supplemented by Safarà Cucito. Any changes and/or additions to the General Conditions will be effective as of the date on which they are communicated to the public and will apply to sales made as of that date. The latest updated version of the General Conditions is the one available on the Site.

2.PRICES

The sales prices of the products illustrated on the Site and/or through any other distance selling systems of Safarà-cucito are inclusive of VAT and any other taxes. Delivery charges are indicated on the Site and/or through any other Safarà-Cucito distance selling systems and, in the case of telephone orders, repeated to the Customer by the Safarà operator.

Delivery charges are 5.49 euros up to 39 euros of order and free of charge above 39 euros. For cash on delivery orders there will be a surcharge of 3 euros.


3. METHOD OF PURCHASE AND PAYMENT

3.1 - The Contract by telephone is finalized by notifying the Customer (who has contacted Safarà by telephone and formulated, on that occasion, a purchase proposal also providing the operator with the data necessary for the registration procedure of his name, purchase order and payment method chosen) that the proposal is accepted.

3.2 - In the case of purchase proposals sent through the Site, the Client will receive from Safarà-Cucito a summary e-mail, by which he/she will be informed that his/her purchase proposal is being processed and will be deemed accepted, unless otherwise communicated by e-mail or telephone by Safarà-Cucito within the term of 3 (three) calendar days from the receipt of the summary e-mail. Once this deadline has elapsed, the Internet Contract shall be deemed perfected.

3.3 - The Customer will be allowed to choose one of the following payment methods:(a) cash on delivery, to be made to the courier who delivers the product; or (b) by any other means of payment from time to time indicated as valid by Safarà-Cucito on the Site.

4.DELIVERY OF PRODUCTS - COMPLAINTS

4.1 - Safarà-Cucito shall deliver the products to the address indicated by the Customer within 30 (thirty) days after the conclusion of the Contract. Usually delivery, though, takes place in 1 or 2 working days.

4.2 - Any complaints may be submitted to the following address: Safarà-Cucito, Via Vacchieri 8, 10093 - Collegno ( TO )
Shipping charges are 5.49 euros up to 39 euros of order and free above 39 euros. For cash on delivery orders there will be a surcharge of 3 euros.
5. PRODUCT AVAILABILITY

Safarà-Cucito accepts Customer's orders within the limits of the quantities of the requested products existing in stock. Therefore, Safarà-Cucito's acceptance of the purchase proposal forwarded by the Customer is subject to the stock availability of the products themselves. Safarà-Cucito undertakes to promptly notify the Customer of any unpredictable out-of-stocks due to excess demand or other causes.
In the event of a shortage of products, Safarà may decide to ship a product of equivalent or higher carat (if specified in the purchase advertisement of the product itself). However, if the product is not to the Customer's liking, Safarà will withdraw the same at no cost and fully refund the Customer.

6.WARRANTIES AND ASSISTANCE

For products purchased by the Customer, the rules regarding warranties and assistance with respect to the sale of consumer goods are applicable to Safarà-Cucito.

All products sold by Safarà Cucito are covered by the conventional manufacturer's warranty and the 24-month warranty for conformity defects, in accordance with DL 24/02.

To take advantage of warranty service, the Customer must keep the invoice or tax receipt that he/she will receive with the machine or goods ordered, and the original packaging of the purchased product.
Exercise of the Warranty may involve requesting assistance from authorized service centers in the territory and/or following the procedures outlined in the documentation inside the product packaging.

The manufacturer's conventional warranty is provided in the manner illustrated in the documentation inside the product packaging.

If, following intervention by an Authorized Service Center, the defect turns out not to be covered by the manufacturer's conventional warranty, the Customer will be charged for any costs of verification and restoration required by the Authorized Service Center, as well as transportation costs, if incurred by Safarà Cucito.

Transportation costs to our service center are always and in any case borne by the Customer. The costs of transportation from our Service Center to the Customer, will be borne by us.

The 24-month warranty under DL 24/02 applies to the product that presents a lack of conformity, provided that the product itself is used correctly, in accordance with its intended use and as provided in the attached technical documentation.
This guarantee is reserved for the Private Consumer (a natural person who buys goods for purposes not related to his professional activity, or makes the purchase without indicating in the order form a reference to VAT). In case of lack of conformity, the Safarà S.R.L. provides, without cost to the Customer, the restoration of conformity of the product by repair / replacement or reduction of the price, until the termination of the contract. If, following intervention by an Authorized Service Center, the defect does not result a lack of conformity pursuant to DL 24/02, the Customer will be charged for any costs of verification and restoration required by the Authorized Service, as well as the costs of transportation if incurred by Safarà S.r.L.

Replacements in case of DOA (Dead On Arrival: product not working on delivery) occur only if expressly provided by the manufacturer. The timing of replacement or eventual repair of the product depends exclusively on the manufacturer's policies.

In the event that, for any reason, is unable to return to its customer a product under warranty ( restored or replaced), Safarà of S.R.L. may proceed at its own discretion to refund the amount paid taking into account the use of the good or its replacement with a product of equal or superior characteristics.

The timing of repair or eventual replacement of the product depends exclusively on the policies of the manufacturer and no damages can be claimed from Safarà S.r.L. for any delays in making repairs or replacements. In cases where the application of warranties provides for the return or repair of the product, the goods must be returned by the Customer in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc. ...); to limit damage to the original package, we recommend that it be placed in a second box; it should be avoided in all cases the affixing of labels or adhesive tapes directly on the original product packaging.

7.OBLIGATIONS OF THE CUSTOMER

The Customer declares and warrants: (i) that he/she is a consumer in accordance with the provisions of Article 3 of the Consumer Code; (ii) that he/she is of legal age; (iii) that the data provided by him/her for the execution of the Contract are correct and true.

8.RIGHT OF WITHDRAWAL

8.1 - With reference to D.L. 206 of 2005 The Customer has the right to withdraw from the contract entered into, without penalty and without specifying the reason, within 14 working days of receipt of the products. The Customer may exercise the right of withdrawal, within the aforementioned period, by expressing it by telephone and by written notice at the offices of Safarà-Cucito referred to in Article 4, to be sent by registered letter with acknowledgment of receipt or by telegram, telex or telefax. The Customer will receive instructions on the return after receipt of the written notice from Safarà - Sewing.

8.2 - The Customer who intends to make use of the right of withdrawal must return the products to the address indicated on the invoice, within 14 working days of receipt of the products.

8.3 - The costs of returning the products are always borne by the Customer. Safarà-Cucito will return, within 14 days from the date of receipt of the products by the Customer:

(i) the full price paid by the Customer in case of return of the product complete with all its parts and functionalities; or

(ii) the part of the price equivalent to the product actually returned by the Customer that has worn the product appreciably and/or such as to significantly diminish its value.

9.COMPETENT COURT

The Contract shall be governed by Italian law. Any dispute relating to the application, execution, interpretation and breach of the Contract shall be within the jurisdiction of the Court where the Customer has its residence or domicile, if located in the territory of the Italian State, or the Court of Turin, if the Customer has its residence or domicile abroad.
